Roger P. Sauer focuses on representing fidelity and surety clients in all of their many and varied needs. His 35-year track record has gained him national reputation as a “go-to” attorney in matters of size and significance. He has chaired trials and arbitrations exceeding eighty days.
Earlier on the East Coast, and then in Washington, Roger has been there to set several milestones.
On behalf of the American Insurance Association, Roger convinced the New Jersey Supreme Court to reverse prevailing law that disfavored sureties. He avoided liability for synthetic stucco manufacturers in national class action litigation. He established the “alter ego” doctrine as a bar to a fidelity claim. He tackled Washington’s biggest institutional “Madoff” loss. He resolved eight-figure litigation spawned by our State’s largest bank collapse and after it had gone through three failed mediations. He tried the federal case that mandated proximate causation in forgery and counterfeiting claims. He used the Washington Statute of Repose to secure a client’s release from an airport calamity.
As special surety counsel to a Fortune 100 company, Roger worked with Canadian obliges, sometimes in French, and over a period of two years resolved all liabilities on a $150 million environmental bond program.
Roger was also assigned the nationwide handling of the entire claim portfolio of a surety in rehabilitation. Consistent with the client’s need to preserve scarce capital, every matter has been successfully resolved, including a $30 million university dormitory renovation project.
When not at work, Roger is usually hiking and climbing in the North Cascades. He is also an activist for Amnesty International.
